TERMS AND CONDITIONS FOR THE PURCHASE OF TICKETS FOR LIVE WORKSHOPS, BOOKING A PRIVATE OR CORPORATE PARTY, VIRTUAL EVENTS, ONLINE ON-DEMAND TUTORIAL, MERRIMENT ATELIER BRANDED PRODUCTS AND USE OF THE MERRIMENT ATELIER WEBSITE

1. DEFINITIONS

The following definitions explain the words we used in our terms.

  • “MA” means Merriment Atelier, registered in England as a limited company with the number 11524996, is the company under which Paint Party Social Club operates.

  • “Content” means all information provided on the website, blog, event information, booking form, and so on.

  • “Ticket” means providing access to our events.

    • Live workshops

    • Live virtual workshops

    • Tutorial on demand

    • Private parties

    • Corporate parties

  • “Ticket buyer” means the person who makes the booking and proceeds with the payment.

  • “Online booking form” is the form that you have to fill out in order to make your booking or to purchase a ticket for events.

  • “Confirmation” means the email that you receive once your order is made.

  • “Live events” means an event that you attend in person. The address of this event is either specified on your booking form or when you sign a contract for a group event.

  • “Virtual live events” means an online event that you can attend from the comfort of your home.

  • “Online event’s link” means the link you will receive before the event so you can have access to the virtual room.

  • “Online tutorial on-demand” means a tutorial that you can get instant access to as soon as you purchase your ticket.

  • “Individual bookings” means bookings that are made for less than six people.

  • “Group booking” means a booking for a group with over 6 guests.

  • “Contract” means the agreement that you made with us when you booked any kind of party for individual or group bookings.

  • “Third-party” means a party other than you and the MA.

  • “Partner venue” means a venue where MA hosts events.

  • “Work art product” means the art that is created by one of our artists.

2. INTELLECTUAL PROPERTY AND WEBSITE USE

2.1. We are the owners of all information contained on this website. We are the owners of any and all copyrights, trademarks, design rights, and other intellectual property rights (registered and unregistered) related to the content and work of art products on this website and all our events (individual, private, or corporate).

2.2. Information on this website may be copied for personal use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from the MA’s website.

2.3. No part of this website may be reproduced, stored, or transmitted in any form or by any means, electronic, mechanical, photocopying, recording, scanning, or otherwise, without the prior written permission of the author other than temporarily in the course of using the MA’s booking service or as permitted by law. The author's and publisher's requests for permission should be addressed to the following email: hello@paintpartysocialclub.co.uk.

2.4. You are not posted on or permitted to link to or use all or any part of the MA’s website for any purpose that is unlawful, defamatory, harmful, obscene, or objectionable.

2.5. You are not permitted to transmit anything that, in the MA’s opinion, harms the MA’s business or in any way offends other users or persons.

2.6. You are not permitted to alter MA’s website in any way.

2.7. You must not post on or transmit to MA’s website any material containing software viruses or files that may damage or disrupt the good working order of computer or telecommunications equipment.

2.5. We allow linkbacks to this website as long as you inform us in advance, clearly credit this website, and provide a hyperlink back to this website.

2.6. We reserve all rights, and nothing in these terms grants you a right or licence to use any information provided on this website.

2.7. The MA may record, preserve, trace, and disclose anything that has been transmitted to, from, or via the MA’s website, where required by law or where the NT is acting in good faith.

2.8. If you create or are provided with a username, password, or any other piece of information as part of the NT’s security procedures, you must treat this information as confidential. In particular, you must not disclose this information to any third party.

3. WEBSITE CONTENT

All content on this website is for informational purposes only. We do not make any representations regarding the completeness or accuracy of the information found on this website. We are not responsible or liable for the accuracy, usefulness, or availability of any information provided on this website. The access and use of any content on this website do not guarantee any specific results, and we are not responsible or otherwise liable in any way for your reliance, acts, or failures concerning the information presented on this website. You are responsible for your own actions, and your reliance on the content of this website is done solely at your own risk.

4. CANCELLATION, NO SHOW, AND REFUND POLICY

4.1. Cancellation and refund for individual bookings (up to 6 guests)

4.1.1. If you wish to cancel your booking for up to 6 people, you can do this up to 14 days before the event. Please email us at hello@paintpartysocialclub.co.uk, and a full refund will be issued.

4.1.2. If you would like to cancel your booking in less than 14 days up to 48 hours before the event, we will offer you a 3-month valid voucher at the full price. We will not be able to extend this period, so you need to use your voucher before it expires.

4.1.3. Loss of payment will occur for “no shows” or a cancellation with less than 48 hours' notice.

4.2. Cancellation and Refund for Group Bookings

Private events: 2 to 3 hours of experience

4.2.1 A minimum of 10 paid guests is required for private parties. Parties of less than 10 people will be accepted, but a flat-priced package fee of will be charged.

4.2.2. To secure the date for a private party, a refundable deposit of £200. After the required date is confirmed, the deposit has to be paid in three days. The event was not confirmed before that. The provisionally booked date will be released after 3 days, and we will offer this date for other inquiries.

Corporate events: 2 to 3 hours of experience

4.2.3 A minimum of 15 paid guests is required for team-building or corporate events. Parties of 9 to 14 people will be accepted, but a flat-priced package fee will be charged. Parties of 2 to 8 people will be accepted, but a flat-priced package fee of will be charged.

4.2.4. To secure the date for a corporate event, a refundable deposit of 30% (up to 14 days before the event) from the total booking is required, but not less than £180. After the required date is confirmed, the deposit has to be paid in three days. The event was not confirmed before that. The provisionally booked date will be released after 3 days, and we will offer this date for other inquiries.

4.2.5. If you have to cancel your group booking less than 14 days or more before the event, we can only offer to rearrange another day in the following 3 months. Depending on our availability, we will offer you a date or dates to reschedule your event. We will not be able to extend this period, so you need to accept one of our available dates.

4.2.6. We do not offer refunds for “no-show” attendance.

4.2.7. We do not offer a refund for any group events if additional materials were required to be bought for the event and this purchase has already been made.

4.3. If a venue partner has to cancel an event due to unexpected circumstances, MA does not take any responsibility. However, we will do our best to postpone the event and negotiate another day for the same event. We will let you know the new dates once we have them released by the venue.

In case of cancellation from our venue partner, we follow all our regular cancellation policies (clauses 4.1 and 4.2 and accompanying subclauses).

4.4. On very unlikely occasions, MA may need to cancel an event due to unexpected circumstances. In that case, we will offer to transfer the ticket to another event, a voucher, or a full refund.

5. PURCHASING TICKETS

5.1. You can purchase up to six tickets through any third-party websites we are working with.

5.2. All bookings for more than 6 people are taken over the phone, via email, or in person.

5.3. The person who makes the booking is responsible for all members attending the workshops and accepts these terms on their behalf. The ticket buyer is responsible for all payments and for communications with everyone who will be attending a live event regarding the NHS Track & Trace requirements you will be asked to meet.

5.4. Only people 18 years old or older can purchase a ticket for the MA workshop. By purchasing a ticket, you make an affidavit stating that you comply with this requirement.

5.5 If there are any changes to your booking that are required, it is your responsibility to inform MA. You have to email us at hello@paintpartysocialclub.co.uk and provide us with the information.

5.6 The MA reserves the right to restrict the number of attendees at live events due to safety and health requirements.

5.7. The MA reserves the right to restrict attendance at a live event or workshop for everyone who does not:

  • Follow the NHS Track & Trace requirements; do not provide us with the information required before the events; and refuse to wear face-covering unless exempt.

  • Shows signs of the threat of coronavirus infection.

  • Shows disrespectful, obscene, or abusive behaviour to other attendees or members of MA staff.

5.8. The ticket buyer can transfer or resell tickets only up to the price of the purchase.

5.8.1. If the tickets are resold for more than the original price, MA has no responsibility or obligations to the person who bought the tickets.

5.8.2. MA has to be informed via email (hello@paintpartysocialclub.co.uk) and provided an email to the new ticket owner, as we need to be able to send important health and safety information about the event.

6. AGE RESTRICTIONS

6.1. Most of our events are hosted in venues such as restaurants, pubs, or bars. Some of our tickets also include an alcoholic option as a welcome drink. The MA reserves the right to ask for proof of ID before attending a live workshop.

6.2. There are no age restrictions for private parties that are hosted in a suitable environment and with the approval of the organiser.

7. BOOKING PROCESS

7.1. MA uses third-party secure websites to sell tickets for individual bookings. Those are Eventbrite, Facebook, Instagram, Stripe, and others.

7.2. It’s the ticket buyer’s responsibility to read the Terms and Conditions for those third parties before proceeding with a booking and payment.

7.3. Any booking fees and taxes collected from third parties during the booking process are not refundable.

7.5 The booking process for individual bookings for workshops or virtual live events has to be made online, following the next steps:

7.5.1. Select an event

7.5.2. Select the date and time you’d like to attend.

7.5.3. Select the number of your guests.

7.5.4. Confirm your intention to book a ticket to attend the workshop.

7.5.5. Confirm that you read our terms, cancellation policy, and privacy policy.

7.5.6. Provide your card details and place the order.

7.5.7. You will receive a confirmation email for your payment.

7.5.8. You will receive an email with your booking information.

7.6. Booking for private parties, cooperative parties, charities, and other groups of over 6 people follows the next steps:

7.6.1. You have to contact us via an online inquiry form, email, or phone call.

7.6.2. After confirming the date of the events you’d like to book, the number of attendees, and details about the party, MA will send you a contract for planning a paint and sip workshop.

7.6.3. The contract has to be countersigned by all parties and bonded with a non-refundable 50% deposit.

7.6.4. The second half of the payment is due 30 days before the event. If the booking is made in less than 30 days, a full amount of payment is required for MA to accept the booking.

7.6.5. Your event can be cancelled, and deposit payment loss can occur if the second payment is not made on time.

8. PRICES AND PAYMENTS

8.1. MA offers different art workshops based on different types of experiences; therefore, there are workshops with different price ranges.

8.2. The regular workshop price ticket includes:

8.2.1 two and a half hours of experience with an art wizard (artists) and a guest experience host (event coordinator).

8.2.2. Brushes, canvas, paints, and everything else required for the workshop is provided by MA.

8.2.3. Some workshops can include other elements to enhance the experience.

8.2.4. Some workshops may include a glass of a welcome drink (wine, prosecco, or non-alcoholic). This information will be listed on the workshop information page.

8.3. MA accepts only online payment via credit or debit card for bookings up to £500 and BAC transfers for any payments over £500.

8.4. We do not accept payments over the phone, and we do not take any credit or debit card information; therefore, we do not store this type of information. If it is required, we will send you a link to a secure Stripe payment. Check out our bank account details so you can safely make your payment.

9. DISCLAIMERS AND LIMITS OF LIABILITY

9.1. MA offers selected art products in our branded MA Amazon Shop: amazon.co.uk/shop/merriemntatelier. MA recommended this product only because we truly believe that it is of good quality and can benefit MA clients. MA is not associated with any of those brands.

9.2. Amazon.co.uk offers a small reward to MA as a thank-you for being a business partner. You, as a client of Amazon.co.uk, will not pay anything different than the official price of the product listed on the Amazon.co.uk website.

9.3. In the event that MA is found liable to you, you shall only be entitled to recover actual and direct damages, and such damages shall not exceed the amounts paid to MA.

10. LINKS TO THIRD-PARTY WEBSITES

The MA’s website may contain hyperlinks to websites operated by parties other than the MA. These could be venue partners, art bloggers, and others. The operation of such websites is outside the MA’s control, and you proceed at your own risk. The MA does not endorse or sponsor and is not liable for the products, services, or content you access through any linked site.

11. DATA PROTECTION

The MA will collect, use, store, and disclose your personal details in accordance with our privacy policy, which can be accessed from the MA’s website homepage.

13. ENTIRE AGREEMENT

All the terms of any contract are contained in or are referred to within these terms and conditions.

14. THIRD PARTY

Nothing contained in any contract is intended to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any third party.

15. GOVERNING LAW

These terms and conditions and any contract concluded incorporating these terms and conditions shall be governed by law,lish law, and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
